Booqui Terms of Use

Please read these terms carefully before using Booqui. By creating an account or using the platform, you agree to be bound by these terms.

1. Acceptance of Terms

By downloading, accessing, or using Booqui ("the Platform"), you agree to be bound by these Terms of Use and all applicable laws and regulations, including those of Malaysia and of the country where you use the Platform (such as Singapore). If you do not agree with any part of these terms, you must not use the Platform. These terms constitute a legally binding agreement between you and Atoz Technologies ("Booqui", "we", "us", or "our").

2. Platform Nature: Intermediary Only

Booqui is a technology platform that connects independent service providers ("Providers") with individuals seeking services ("Customers"). Booqui acts solely as an intermediary marketplace.

Booqui does not:

• Employ, supervise, or control Providers
• Guarantee the quality, safety, or legality of any service listed
• Participate in or oversee the actual delivery of services
• Act as an employer, agent, or partner of any Provider

All services are offered and provided independently by Providers. The relationship between a Provider and Customer is a direct private arrangement. Booqui is not a party to any service agreement between Providers and Customers.

IMPORTANT: By using Booqui to book or offer services, you acknowledge that Booqui is a platform only. You are engaging with other users entirely at your own discretion and risk.

3. User Eligibility & Age Policy

Booqui is open to users of all ages, subject to the following conditions:

• Users aged 18 and above may register and use all features freely
• Users aged 13–17 may register with the explicit consent of a parent or guardian. By creating an account, minors confirm that their parent or guardian is aware of and has permitted their use of the Platform
• Users under the age of 13 are not permitted to create an account or use the Platform

Parents and guardians are fully responsible for monitoring and supervising the use of Booqui by minors in their care. Booqui reserves the right to terminate any account found to belong to a user under 13.

By creating an account, you confirm that you meet the applicable age requirements and, if between 13–17, that you have obtained parental or guardian consent.

FOR PARENTS & GUARDIANS: If your child aged 13–17 uses Booqui, you are responsible for supervising their activity on the Platform. We recommend reviewing their bookings and communications regularly.

4. Personal Safety & User Responsibility

Booqui strongly encourages all users to take personal safety precautions when arranging in-person services. Users are solely responsible for their own safety and the safety of others involved in any service arrangement.

Booqui recommends that you:

• Meet Providers in public or well-lit locations where possible
• Inform a trusted person of your booking details and location
• Trust your instincts: cancel or leave if you feel unsafe
• Verify Provider identity before allowing entry to your home
• Do not share sensitive personal or financial information in chat
• For minors: always have a parent or guardian present for in-person services

You acknowledge that Booqui has no ability to screen, verify the background of, or monitor the real-time actions of any Provider or Customer. Any decision to engage with another user is made entirely at your own risk.

SAFETY WARNING: Booqui does not conduct criminal background checks on Providers. You are responsible for independently verifying the suitability of any Provider before engaging their services, particularly for in-home services. For users aged 13–17, a parent or guardian must be present for all in-person service arrangements.

5. Disclaimer of Liability

To the fullest extent permitted by applicable law, Booqui, its directors, employees, partners, and agents shall not be liable for:

• Any personal injury, death, illness, or physical harm arising from services booked through the Platform
• Any property damage, theft, or loss occurring in connection with a service
• Any emotional distress, psychological harm, or trauma arising from interactions between users
• Any financial loss, fraud, or dispute between Providers and Customers
• Any illegal acts committed by Providers or Customers
• The accuracy, quality, safety, reliability, or legality of any service listing
• Any interactions between users that occur outside the Platform

In no event shall Booqui's total liability to you for any claim exceed the amount of fees paid by you to Booqui in the six (6) months preceding the claim.

6. Indemnification

You agree to indemnify, defend, and hold harmless Booqui, its officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:

• Your use of or access to the Platform
• Your violation of these Terms of Use
• Your violation of any applicable law or regulation
• Any dispute between you and another user
• Any service you provide or receive through the Platform
• Any content you submit, post, or transmit through the Platform

For users aged 13–17, the parent or guardian who provided consent shall be jointly responsible for any indemnification obligations.

7. User Conduct

All users agree not to use Booqui to:

• Engage in any illegal activity under applicable law
• Offer or solicit sexual services of any kind
• Harass, threaten, or abuse other users
• Post false, misleading, or fraudulent listings
• Impersonate any person or entity
• Solicit personal contact information to bypass the Platform
• Post offensive, defamatory, or inappropriate content
• Engage in any activity that endangers the safety of others
• Target, exploit, or harm minors in any way

Booqui has zero tolerance for illegal conduct. Violations will result in immediate account suspension and may be reported to the relevant authorities, including the Royal Malaysia Police (PDRM) or the Singapore Police Force (SPF).

8. Reporting & Moderation

Booqui provides a reporting mechanism for users to flag inappropriate listings, profiles, or behaviour. Reported content will be reviewed within 24 hours. Booqui reserves the right to remove any content and suspend or permanently ban any account found to be in violation of these terms.

If you believe a crime has been committed, you must report it directly to the police by calling 999 (in both Malaysia and Singapore) or visiting your nearest police station. Booqui will cooperate fully with law enforcement investigations upon receiving a lawful request.

9. Payments & Refunds

All payments are processed securely through Stripe. Booqui does not store your card details. By making a payment, you agree to Stripe's Terms of Service.

Prices are shown and charged in the local currency of the service (RM in Malaysia, S$ in Singapore). Your card issuer may charge its own foreign transaction or currency conversion fees.

Cancellations: if you cancel at least 48 hours before your booking, you will receive a refund of 90% of the amount paid. Cancellations made less than 48 hours before the booking are not refunded. If a Provider does not show up, you can report a no-show in the app and our team will investigate and contact you about a refund.

For other disputes, both parties are encouraged to resolve them directly. Booqui may, at its sole discretion, assist in mediation but is under no obligation to do so.

10. User Generated Content

Service Providers are solely responsible for the accuracy, legality, and appropriateness of their listings and all content they post on the Platform. By posting content, you grant Booqui a non-exclusive, royalty-free licence to use, display, and distribute that content within the Platform.

Booqui does not endorse any content posted by users and makes no representations about its accuracy or reliability.

11. Privacy & Data

We collect and process your personal data in accordance with our Privacy Policy, the Personal Data Protection Act 2010 of Malaysia and, for users in Singapore, the Personal Data Protection Act 2012 of Singapore. By using Booqui, you consent to the collection and use of your data as described in our Privacy Policy.

For users aged 13–17, parental consent is required for the collection and processing of their personal data in accordance with PDPA requirements.

Your chat messages and booking history are stored securely and may be accessed by Booqui in cases of reported misconduct or legal requests from authorities.

12. Account Deletion

You may delete your account at any time from the Profile section of the app. Account deletion is permanent and cannot be undone. Upon deletion, your personal data will be removed subject to any legal retention obligations. Booking records and chat history may be retained for up to 7 years for legal compliance purposes.

13. Governing Law & Jurisdiction

These Terms of Use shall be governed by and construed in accordance with the laws of Malaysia. Any dispute arising from or in connection with these terms shall be subject to the exclusive jurisdiction of the courts of Malaysia. Nothing in these terms limits any mandatory consumer rights you have under the laws of the country where you live.

Booqui operates in compliance with Malaysian law including but not limited to:

• Personal Data Protection Act 2010 (PDPA)
• Communications and Multimedia Act 1998
• Consumer Protection Act 1999
• Child Act 2001 (for protection of minors)
• Contracts Act 1950

14. Changes to Terms

Booqui reserves the right to update these Terms of Use at any time. We will notify users of material changes through the app. Continued use of the Platform after changes are posted constitutes acceptance of the updated terms.
